PARTICIPATION AGREEMENT AND WAIVER FORM
The undersigned parent and/or legal guardian (hereinafter “I”) desires to register his/her child (the
“Student”) to participate in one or more theater summer camp (s) (the “Activity(s)”) provided by All In
Theatre, (“All In Theater”). In consideration of the Student being permitted by All In Theatre to engage
in the Activity(s) and in recognition of All In Theater’s reliance hereon, I (and/or the Student) agree to all
the terms and conditions set forth in this Participation Agreement and Waiver Form (this “Agreement”).
Participation Agreement
I understand that the Student’s participation in the Activity(s) is voluntary and that as a condition
of the Student’s participation, I agree to comply with all Activity(s) requirements including, but not limited
to: (a) accurately completing all registration forms and responding to emails (when appropriate) in a timely
manner, (b) ensuring that the Student is aware of the Activity(s)’s code of conduct, (c) taking time at home
to rehearse class materials with the student as provided by the teacher(s); (d) and immediately notifying All
In Theatre of any concerns related to the health, safety, or security of the Student, other participants, or All
In Theatre’s staff.
Fee and Term
I agree to pay All In Theatre $150 for each the Activities registered for taking place from June 24,
2024 to June 28, 2024, July 15, 2024 to July 19, 2024, and August 5, 2024 to August 9,2024 (“Semester”).
The Fee(s) will be paid in its/their entirety at the beginning of the Semester.
I acknowledge that excessive absences may result in a termination of this Agreement based on All
In Theatre’s sole discretion. Removal of the Student from the Activity will result in a forfeit of the
registration fee. There will be no refunds given after the start of the prospective camp, June 24, 2024, July
15, 2024, and August 5, 2024.
Code of Conduct
By signing this Agreement, I (and/or the Student) consent to the following:
1. All Students are expected to attend every class or give a written notice in advance.
2. All Students are expected to demonstrate respect for all instructors, assistants, staff members, and
fellow Students.
3. All Students are expected to focus and pay attention to the best of their ability to the teacher’s
instructions.
4. All Students must treat All In Theatre, the Pollock Center, and the possessions of all other Students
with respect, care, and consideration.
5. All Students must agree to practice appropriate class materials such as their lines, music,
choreography, etc. at home.
Image/Voice Permission
I agree that photographs or video/audio recordings may be taken of the Student while engaging in
the Activities. Unless I request otherwise, this Agreement will be considered permission for All In Theatre
to photograph, film, audio/video tape, record and/or publish the image and/or voice of the Student for use
in any publications or promotional materials, in any medium now known or developed in the future without
any restrictions. If I object to All In Theatre using the Student’s image or voice in this manner, please notify
All In Theatre, in writing, upon submission of this Agreement.
RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND
INDEMNIFICATION
Though All In Theatre will do everything in their power to ensure the safety of the Student, I
understand accidents, and unforeseen things can happen including the risk of serious physical injury,
temporary or permanent disability, and death, as well as economic and property loss. I also realize that
participating in the Activities may involve risks and dangers, both known and unknown, and I have chosen
to allow the Student to take part in the Activities.
I, FOR MYSELF AND/OR THE STUDENT, KNOWINGLY AND FREELY ASSUME, ALL
RISKS, BOTH KNOWN AND UNKNOWN, EVEN IF ARISING FROM THE NEGLIGENCE OF ALL
IN THEATRE AND ANY OF ITS OFFICERS, DIRECTORS, MEMBERS, EMPLOYEES, AGENTS,
REPRESENTATIVES, CONTRACTORS, AFFILIATES, SUCCESSORS AND ASSIGNS, OR THE
OTHER STUDENTS IN THE ACTIVITIES (EACH, A “RELEASEE”), AND ASSUME ALL
RESPONSIBILITY FOR DAMAGES OR INJURIES TO PERSON (INCLUDING DEATH OR
DISABILITY) OR PROPERTY, ARISING OUT OF MY PARTICIPATION OR THE STUDENT’S
PARTICIPATION IN THE ACTIVITIES.
I, for myself and/or the Student, and our respective heirs, personal representatives, and assigns, do
hereby:
a. release the Releasees from, and agree not to sue the Releasees for, liability
for damages or injuries to person (including death or disability) or property, to the fullest extent
permitted by law, regardless of whether arising from the negligence of any Releasees, which may
arise from or relate to the Student’s participation or involvement in the Activities; and
b. agree to indemnify and hold the Releasees harmless from any and all
claims, actions, suits, procedures, costs, expenses, damages and liabilities, including attorneys’
fees, with respect to any and all damages or injuries to person (including death or disability) or
property, to the fullest extent permitted by law, regardless of whether arising from the negligence
of any Releasees, which may arise from the Student’s participation or involvement in the Company
activities.
I (and/or the Student) will comply with all federal, state, and local laws, orders, directives, and
guidelines related to the Activities. I (and/or the Student) will also follow all instructions, recommendations,
and cautions of All In Theatre at all times during the Activities. If at any time All In Theatre believes the
Student to be a danger to themselves of others, All In Theatre may terminate the Student without
reimbursement of the Fee.
In the event of an accident or serious illness, I authorize representatives of All In Theatre to obtain
medical treatment for the Student. I hold harmless and agree to indemnify All In Theatre, and all other
Releasees from any claims, causes of action, damages and/or liabilities, arising out of or resulting from
such medical treatment. I further agree to accept full responsibility for any and all expenses, including
medical expenses that may derive from any injuries to the Student that may occur during his/her
participation in the Activities.
Miscellaneous
This Agreement constitutes the sole and entire agreement with respect to the subject matter
contained herein and supersedes all prior and contemporaneous understandings, agreements,
representations, and warranties, both written and oral, with respect to such subject matter. If any term or
provision of this Agreement is invalid, illegal, or unenforceable in any jurisdiction, such invalidity,
illegality, or unenforceability shall not affect any other term or provision of this Agreement or invalidate or
render unenforceable such term or provision in any other jurisdiction. All matters arising out of or relating
to this Agreement shall be governed by and construed in accordance with the internal laws of the
Commonwealth of Pennsylvania without giving effect to any choice or conflict of law provision or rule
(whether of the Commonwealth of Pennsylvania or any other jurisdiction). Any claim or cause of action
arising under this Agreement may be brought only in the federal and state courts located in Dauphin County,
Pennsylvania and I hereby consent to the exclusive jurisdiction of such courts.
I, on behalf of myself and the Student, agree that the terms and conditions of this Agreement are
binding on the representatives, heirs, successors and assigns of myself and the Student.
I, THE UNDERSIGNED PARENT AND/OR LEGAL GUARDIAN, AFFIRM THAT I AM
FREELY SIGNING THIS AGREEMENT. I HAVE READ THIS AGREEMENT AND FULLY
UNDERSTAND THAT BY SIGNING THIS AGREEMENT I AM GIVING UP LEGAL RIGHTS
AND/OR REMEDIES WHICH MAY OTHERWISE BE AVAILABLE TO MYSELF AND/OR THE
STUDENT REGARDING ANY LOSSES THE STUDENT MAY SUSTAIN AS A RESULT OF
PARTICIPATION IN THE ACTIVITIES.
